Legal aspects of cultural diversity Essay Cultural diversity is of great essence to any community, just as diversity is important to the living organisms which can in fact, have their ecological system adversely affected, lack of cultural diversity can lead to an increase in the risk of economic and political instabilities. This therefore implies that it is very important to preserve cultural diversity. Its preservation, above all conflicts and security concerns has made it to be of much concern in the global arena. For effective integration of the cultural diversity there is need to develop and enact laws that are intended to preserve it so as to continue enjoying its numerous benefits (Heuberger, Gerber, Anderson, 1999). Legal aspects of cultural diversity A major fundamental characteristic that is emerging as a result of political space that is increasingly widening globally is not so much due to plurality but as a result of polarity of thoughts coming from different corners of the globe which vary significantly. The polarity of these ideas naturally corresponds to the cultural diversity of the communities. Polarity does not necessarily lead to development in the negative direction in the process of social politics. However, there is need to derive some values which are useful from this particular development. This therefore means that there should be efforts which are aimed at developing institutional mechanisms, which apart from acknowledging the existence of cultural diversity they also stress on the fundamental consensual principles and values as a basis of any state. The potentiality of such opportunities lies in the enactment of laws intended to safe guard cultural diversity, such laws should be well entrenched in a country’s supreme law, that is, the constitution (Tarver, 1999). The ethnic and cultural diversity is a broad area which can be very problematic should states fail to adequately cater for them in their laws of the land. When properly managed, cultural diversity is capable of producing positive fruits in the development of institutional structures aimed enhancing integration of various cultures. It is therefore important to note that dealing with ethnic and cultural diversity is not only a sensitive issue but a complex one too. Thus it is of much essence to include virtually all the stakeholders while coming up with laws of regulating and governing this diversity. This is very important since if such a process is not well managed the minorities are likely to feel left out in the development of their nations and thus opposed to its objectives. This can result into anarchy in a country, which can easily lead to tribal conflicts which do not auger well for the economic and political stability of a nation (Mitullah, 2002). The differences in various cultures are not absolute, they can therefore, be mediated positively through a well engineering process of the constitution of the country or other laws governing the state. This is a task that every country should endeavor to accomplish so as to avoid instances of discrimination of minorities. Their values too should be well taken care of and appreciated in a similar manner as those of the majority. Making laws on such basis will ensure that no single culture is left out in the task of nation building as they are all important and each form an integral part of the nation and thus a state cannot function optimally without the inclusion of all the cultures existing within its boundaries (Mitullah, 2002). By the laws properly addressing the issue of cultural diversity the states are likely to be saved from effects of conscious mobilization of people based on their culture and ethnic origins by their elites who are selfish and only interested in their political gains as opposed to the greater good of the entire nation. Such laws should ensure that there is eradication of political processes in which politicians are able to divide people during the periods of campaigns through ideas of cultural differences instead of policies that are needed by the state in order to develop both democratically and economically and thus liberate the citizens from the handicaps of ethnicity and their respective cultures. The laws should enable the citizens to perceive each culture in the country as an important part in the general development of the nation (Mitullah, 2002). In many countries ethnic or cultural social engineering so as to achieve myopic political goals is a major challenge in attaining credible political and economic stability. Not unless such is adequately addressed several countries will continue suffering and their development objectives delayed. Such short comings can be effectively addressed if there are laws and statutes to cater for cultural diversity so that it can be used to yield good fruits for these nations as opposed to situations of political and economic instabilities resulting from failing to manage cultural diversity in a proper manner (Lewis, 2007) Conclusion Cultural diversity when well managed in any given society is capable of yielding a lot of benefits to the all the nationalities. There is need therefore to ensure that it is well preserved and adequately taken care of so as to realize the benefits of stable economies and political systems. By appreciating cultural diversity the members of the different communities are able to borrow the strong values from other cultures and this will lead to the emergence of a culture that incorporates all the cultural diversities that exist within their limits. Slavery was present preceding the European discovery of the Americas. It was limited to the conquered people of the indigenous nations and it was not widespread. This situation changed with the arrival of Europeans, as they possessed modern weapons with which they were able to overtake the most formidable segments of native tribes. Sickness introduced to the indigenous tribes by the Europeans reduced the enslaved population to the point that new workers were needed. A slave trade was brought into existence by this need. Slaves were still gathered from indigenous tribes, but they were supplemented with African slaves brought by ship. These events helped to forge the Americas into the prosperous cultures they eventually became. Slavery influenced culture during the revolutionary period with the beginnings of racism, this culture change initiated lawmaking concerning race, which started with the first emancipation around 1780. How these two topics were molded until the 1850's, and have remained present in the modern era of our lives will be proven in the following essay. The word racism is a term used to describe the believed differences between people of different colors, because of traits, morals, or intellectual prowess. These perceived differences cause a racist person to treat a person of color in ways that would be unaccepted by most people in their own race. A Comparison of Because I Could Not Stop For Death and Up-hill

It is quite peculiar that there are people who are not afraid of dying or death. Admittedly, most of us are either too afraid to face death or death itself. However, there are exceptions to the rule; and notably, Emily Dickinson and Cristina Rossetti are just some of the people who lovingly welcome the idea. Since both are also poets, they were able to portray their ideas regarding the matter through poems.In Emily Dickinson’s â€Å"Because I Could Not Stop for Death†, she used a technique of remembering imagery of/from the past to elucidate never-ending conceptions; and this; she was able to do through establishing a dialectical relationship between one’s imagination and reality. In her poem, she suggested the subject of interconnection and the reciprocally determined personalities of the known and unknown through viewing the particular correlations between the two holistically and hierarchically.Moreover, she talks about death and eternity. And from the perspec tive of eternity, she remembered experiences that happened so long time ago and from those recollections, she endeavors the eternal world through its rapport with sequential standards.For Dickinson, Death is a kind and comforting gentleman and she adds positive subtexts about it. In this particular poem, Dickinson eternally combines and increasingly orders the temporal world with divine universe. She was able to dialectically shape some sense from the confines of life; thus permitting her readers to have a temporary glance to a universe which have an outwardly different and sporadic stages of existence that at the same time is holistically purposed and drawn in (Dickinson).Meanwhile, Cristina Rossetti also flirted with the same topic on her poem â€Å"Uphill†. In this poem, she talks about the never-ending struggles that we have to endure in life. She successfully achieved it by comparing life to an extensive and hard journey uphill—coated with lots of metaphor that is obvious all throughout the poem.Obviously, the poem is about a traveler inquiring another traveler about the whole journey. Furthermore, the poem is constructed in such a way that Traveler 1 will ask a question and Traveler 2 will answer him back and this goes on until the end of the poem. But yet, if we examine the poem closely, it is more than that.There is so much symbolism and allegory in the poem. In this poem, symbolism inspired Rossetti to write—there are overflowing concealed meanings through the use of allegory. Through closer examination, allegory is fabricated in the course of the entire poem rather then just having it within two lines or so.Nevertheless, the main theme that Rossetti wants to impart to her readers is that no matter how long or hard a journey one may encounter, there will be Someone who will never let you go (in this case, God) and that one cannot miss heaven. Since she is devout Anglican, her poems are at the same time about the idea of Death and religion. This particular poem talks about that topic in a sorrowful and death-obsessed manner (Rossetti).Both authors and poems reiterate the concept of death. In these two particular examples, the difference is how the authors created and styled their poems in different manners. Emily Dickinson used metaphors to convey her message while Christina Rossetti used allegory in her poems. Breast cancer is the second most commonly diagnosed cancer in American women and around 12 percent of women will develop invasive breast cancer in their lifetime.1 Patients have the choice of 5 different types of mastectomy: total mastectomy with removal of breast tissue without lymph node removal, modified radical mastectomy where the entire breast and axillary lymph nodes are removed, radical mastectomy where entire breast and chest muscles are removed, partial mastectomy frequently referred to as breast conservative surgery where only cancerous tissue is removed, or subcutaneous mastectomy where breast tissue is removed with conservation of the nipple and areola.2 The standard of care in the United States for women who have had mastectomy secondary to breast cancer is to receive a breast reconstruction.2 On top of a common but devastating diagnosis of breast cancer with fears of facing months of chemotherapy and radiation, most women also make the decision to beat the cancer with a mastectomy and reconstruction. The Bad Boyfriend, the Decent Boyfriend Free Essays

When it comes to types of boyfriends out there, guys fall into three categories the bad boyfriends, the decent boyfriends, and prince charming. The bad boyfriend is the guy that doesn’t treat his girlfriend the way she deserves to be treated and tends to go after girls with low self-confidence because honestly he couldn’t get any other girl. He does many things to her including cheating, lying, abusing, using, and not meeting her needs. He might mentally or physically abuse her making her feel bad or sad. He uses her for what she can offer him and almost expects it in a way. A lot of bad boyfriends don’t meet their girlfriend’s needs. He doesn’t pay attention to her needs, like, or wants. He does all this because he simply does not care for her. This type of boyfriend is the lowest of all boyfriends, and if you are this guy then you need to understand that she will eventually get a backbone and dump you. The next type is the decent boyfriend; this is the boyfriend that tries sometimes. He tries to understand what she wants and needs and tries to give it to her. He doesn’t know exactly what she wants but tries to please her with whatever he does know. He loves her but wishes she was less nagging and gets upset with it instead of trying to fix the problem. He gets along with some of her family and friends. The decent boyfriend would rather watch TV or play video games then talk or hangout with his girlfriend. He may not be very romantic and he will hardly ever surprise her with things or occasions. He doesn’t like expectations put on him by her and he tries not to do anything so that she will not start to expect stuff. This type of boyfriend pleases her to some degree but doesn’t really get her and put effort into understand her. This guy makes women question a lot of things and go through moods of feeling good and feeling angry. The confusion shows itself as anger or tears mostly which makes him more confused and hurt her more. If you are this guy you need to start rethinking on how you go about relationships. You are never going to be in a healthy and good relationship with a girl until you start communicating properly and understanding her needs and meeting them. The last type of boyfriend would be prince charming. Obviously this guy is a catch and women would love to have him as a boyfriend. He’s not without some faults but when it comes to their relationship he puts more effort in then the other guys. His traits would include: he understands what she needs emotionally, he communicates well which includes both talking and listening, he doesn’t lie or use her but instead shares his life with her, he is patient with her and her emotions and he is always there for her to lean on. He surprises her with things that show her how much he cares about her, he doesn’t let her get down on herself and instead lifts her up. And last he views her as a lover and a best friend. This guy gets his woman and if he doesn’t get her then he figures out how to please his woman. He’s not a pushover but he’s genuinely a nice guy who cares about her and her feelings. Of course there are many other types of boyfriends but these are the main three that I have found that my past boyfriends have fallen under, except prince charming. I have not yet found him but one day I’ll know exactly who he is from dating the other type of boyfriends.
